Digital Millennium Copyright Act Notice

Claims of Copyright Infringement & Related Issues (17 U.S.C. § 512)

Luxury Presence, Inc. respects the intellectual property rights of others. If you believe material hosted on or accessible through our services infringes your copyright, you may notify our designated copyright agent. Your notice must be in writing and include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work you claim has been infringed. If a single notice covers multiple works at a single online site, you may provide a representative list of those works.
  3. Identification of the material you claim is infringing and should be removed or disabled, with enough information for us to locate it (for example, the specific URL).
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

When we receive a notice that substantially complies with these requirements, we will act expeditiously to remove or disable access to the identified material. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

Counter-Notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated agent. It must be in writing and include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal.
A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which Luxury Presence may be found.
A statement that you will accept service of process from the person who provided the original notice, or that person’s agent.

When we receive a valid counter-notification, we will forward it to the person who submitted the original notice.

We may restore the material 10 to 14 business days after receipt, unless our designated agent first receives notice that the complaining party has filed a court action seeking to restrain the alleged infringement.

Repeat Infringers

In appropriate circumstances, Luxury Presence will terminate the accounts of users who are repeat infringers.
